when the infra red light in the engine to tender connection is out and the engine can not control the sound how do you fix it. The tender sound is always on on a new engine and dosent matter if the base is transmitting or not.

You first try to determine what is broken. One of the simple things is the tether sensors get knocked out of alignment, wires can be disconnected or broken.
If you have a different wireless tether locomotive, you can try it with the failing engine. The test tender from the working set should be the same system, i.e. TMCC or Legacy.
If it works, the issue is in the tender, if it doesn't, it's probably the engine. That gives you a place to start looking.
Ditto what John said, but how do you know it is out? Are you looking thru a device that can see IR light? G
The sounds are starting up in conventional mode which means no como between engine and tender. Not knowing what engine we are talking about, I would first try reprogramming. Then as John said swap tenders and see which is at fault.

Bill, I keep forgetting to mention the reset, but you're 100% right, that's the first thing to try!
IMO, I would like to see people put the 6 dash number in their posts. this way we are sure someone is not trying to make an engine do something it was not designed to do.
The engine will receive commands from the handheld as I programed it for eng 9 and the headlight flashed and the engine will run, but no chuffing. The tender just makes the the stationary sounds . In the no base mode it will run but not chuff and will not change direction. it is the 2004 sp ac9 6-38031. it was reprogramed as it says in the manuel, eng 9 set aux1 and 74 code and no difference

I would carefully check the IR sender wiring in the engine before assuming its shot.
Check continuity back to pins 19/20 and pin 24 of the R2LC plug. This is done with the R2LC removed and no power to the engine.

The IR LED is a fairly robust item, I have to agree with Rod, the wiring, connectors, or boards would be my first suspects.
It is on its way back to Nassau Hobbies for repair being it is a brand new loco but no warranty from lionel. They are being good about it for paying return postage fix it and ship it back.
That's pretty decent of them, I'm sure you'll get it back in fine shape.
