I wouldn't be overly concerned if I were you. If the charging circuit works, then all is well. If it doesn't, then I'm sure that Lionel will fix it for you quckly.   My Legacy system came with V1.4, and has a faulty charging circuit, so it's not limited to any particular version.  I haven't had mine fixed yet, as I don't wish to be without it for the amount of time it will take to get it fixed. (I live in Europe, and so shipping time is several weeks for a 2-way journey.) So, like many others, I just charge my batteries in an external charger, and have switched off the charger on the base. This way I always have a fully charged set ready to go when needed. 

I'd send it back, but then I have serious OCD about things not working.   They have a new charging circuit that they're replacing the one in the units with.

 

One issue with the #990 charging, even with the new circuit, is it gets the batteries (and CAB2) hotter than I like, so I don't charge in the CAB2 anyway, I use the #993 charging base.  Given that fact, you may want to go Nicole's way and just charge them externally.

is it 1.1?

Never saw a 1.1, but it was the 1.0 without the silver dot.

When I got my set back from being upgraded they indicated in the paper work that they replaced several components. I'm guessing that is the fix for the charging circuit.

On mine they just replaced an SMT fuse.
