The item is brand new.  Set-up per instructions and the alternating lights work on both signals but no sounds and the gates are locked in position horizontal and 

wont budge.  Is there any tips out there to get this to function or should I take to my hobby person????

It has been a couple of years since I hooked mine up, but had a similar problem. You need to make sure that the two isolated track sections are on the same side and I think underneath shows which side the isolated rails need to be connected. I had mine accidentally reversed and the gates stayed down and lights blinked (don't think I had sound).

If there are no markings underneath, you could just flip the isolation tracks on both sides to see if that corrects problem.

The underside of the crossing says "Insulated or Isolated Rail" This is the side that the isolated track sections go on. Also, there is a small switch next to the center rail on one end. The switch needs to be closest to the center rail to get the sound to work. There is also, a 3-4 second delay after the last car clears the isolation track before the gates go back up.
