Giant shocker. Doc Called it, addicts will steal anything to get money and won't even think it's wrong. I worked with a guy who did this, when he started stealing from us co-workers (You wouldn't believe the excuses and justifications he tried when he was caught), a couple of guys took him out back and beat the holy [bleep] out of him and he quit because he knew the rest of us would call the cops on him and in prison he'd have to become someone's girlfriend for a fix...

Ya I sure do not wish this to happen to anyone the loss of approximately 95 percent of my Entire lifes collection gone because of stupid SSSS

Sorry about your train gear.   After that being said, guys let's get real about this, there are only two kinds of people, PEOPLE THAT GIVE AND PEOPLE WHO TAKE…!!!  Now the people that give are greatly out numbered by the people who take.  People that take, constantly prey on people that give 24-7, 365 days a year…!!!!

Persons on drugs are sick people that are drug dependent.  When you are drug dependent you will do anything necessary to get more drugs and I mean anything to anyone, family included…!!!   An important question is why are their hundreds of thousands of drug dependent people in this Country….????   Also understand that drug's are a multi billion dollar industry in this Country.

Go to the pawn shop with photos, receipts and a state trooper.  Recover your stolen property.  Stolen property is still stolen property and is owned by the original owner  no matter who paid what for it.

Hinton is a neat ol' place in a beautiful state.  One road in, one road out it seems.  Plus there is a little old house a block off the main drag with a few trains on display which fancies it's self a museum of sorts.  The town is so small that "museum" place may be aware of the train situation.

Not saying Hinton is still small but until awhile ago they had three digit phone numbers:

well one of the forum members requested that i put up a comprehensive inventory of the missing Trains and here it is I am not sure if it will show up but it is a word document with pictures of the missing equiptment

as always I appreciate all the help that the OGR Forum Members give out

All I can do is to keep some good thoughts for you that this all works out quickly and to your satisfaction with a minimum amount of aggravation and stress.  I look forward to your post letting us know it has all worked out.

ya they got almost all of it

and i am still getting ditched when trying to find out where the trains are

still working with local law enforcement to locate the pieces

ED i appreciate all the thoughts and for the forum members to keep their eyes open it is really bad when most of these trains were purchased to add to a small collection for me to do holiday displays with. this is my calling i love to set up at christmas and watch the kids faces when they light up and point to a train. The local library has called me their local ELF and i try to live up to their requests which are very easy to do.

next installment in my dilemma 

local officer just got in touch with me and told me that over a phone conversation i gave them the trains. and there is nothing criminal that they can be charged with. however this did not happen the officer has told me that the only thing that i could do is file a lawsuit with the magistrate court and do it that way.  

another advisor states that the witnessess that heard this over the phone is not admissible so i go and talk to West Virginia State Police to see if there is anything I can do

Wow, that is hard to believe that a Criminal can just claim the stolen property was "Given" to them, and that is the end of the investigation.

Gee officer I was just standing there at the bank, when the teller starts "GIVING" me Money!! 

I am SURE, that the fact that I was holding a Gun, pointed in their direction, had NOTHING to do with their GENEROSITY

officer alsp states that the inlaw verified that the trains were pawned and were removed from pawn and still there is really nothing that i can do

 well this changed i was able to give the officer copies of Facebook messages that was sent between me and the inlaws that show a definate shadow on their story that i gave them the trains

welll here is the final update to this dilemma 

The Trains are Gone and it comes up to a civil case to the point that the trains are leverage to me for the court case to which i have been served a judgement to which i did not know about so my trains are deing held for blackmail for 

me to pay five thousand to get them back 

I have to do this or walk away 

This sucks so bad it really hurts

This scenario is about as strange as it can get. The trains are not gone if someone you know is holding them for a payout. Looks like some good ole baseball bat persuasion is needed.

pay 5 thousand to ex landlord that went to court and filed a lawsuit against me and i just found out about this from the city cop that has been working on this since august i have posted all about this in this thread  i will post again The Ex landlord is stepdad to female inlaw

so the trains are basically blackmail

1 Ex landlord illegally evicted me and my wife however we got out of the house

2 I had heart trouble with the cath that was put in and could not pack the house so i got help however read back and yu will find the other parts of this.

3 in August my oldest son told me that my gold set had been pawned By the inlaws

I immediately contacted the people who had the trains in their possession and made an excuse to get them.  They made excuses and excuses and this lasted till Halloween when I contacted the officer again and he went and talked to the inlaws and their friends who suppsoedly heard me on the phone give them the trains which i did not

4 Have not heard from anyone or anything from magistrate or the police till tonight 

to which i had a prowler around the house so i called the police and it was the officer i have been dealing with on this since August  and the information that i sent is what I was told it is now a civil case matter and the Trains are in the possession of the Ex landlord and he told the officer i pay him and i can have the trains back

The Cop has said his hands are tied and everything runs through the magistrate here apparently Also the Judgement that has been passed I delivered my response on October 9th the day after a holiday on which the court was closed I called to find out if they were open and I delivered this to them and Have heard nothing not a sound from any one or any agency.  Tomorrow i call my Legal Aid Attorney to notify him of the situtation and I have been advised to contact the ACLU about this to see if they can get involved.

So the trains were taken as collateral by someone who you owed money to?

not in the beginning of this 

the collateral issue showed up recently when stepdaddy steped in and took the trains out of pawn to protect the stepdaughter and son in law  from being hit with criminal charges for felony Theft 

The Ex landlord came into possession of the Trains and due to the fact of the judgement that the magistrate court has filed in his favor without my knowledge he now has 1 The Judgement of the supposed damages to the Rental property and he has possession of My Train Collection to which he told the police officer if i paid him his judgment amount i could have my train collection back however with him i know that this will not happen 

the court case was given to me in september and I contacted legal aid 

and got help and was advised what to do 

At that time the Trains were in the possesion of the Inlaws and had been stolen and read back in the post and you can see what transpired 

I replied to the court on oct 9th and I have heard nothing from anyone I have worked with the local cop and he finally gave me the last bit of information about the judgement and the Blackmail Tonite 

At the risk of sounding rude, it seems you have bigger issues than the trains. Maybe get that stuff straight- a hobby will always be there, but these other things will keep following you.

I agree this is something that I have never had to deal with 

however how this was done is totally illgeal and they are going to get away with it 

Right now as i posted the Trains are gone as I will never see them again no matter what i do at this point I would have to pay the five thousand and then pay what he had to pay to get them out of pawn so it is even greater than five thousand 

Lord God I would love to hear from loco lawyer on here 

maybe he could help shed light on this mess 

So it was proven in court that you owed some folks some money and they kept the trains as settlement.

It was his extended family members that took the trains and had the judgement placed on them. His stolen trains were used by the extended family members in their matter with the their Landlord.

Bobbie is the victim here. Trains stolen and trust broken.

I never got a hearing notice therefore i did not stad before a judge

the judgement against me was put in place because according to them my response to  the suit papers was late and due to that fact i automatically had the judgemenbt

me and my legal aid lawyer knew nothing of this we have been waiting on the court date which will not come  this happend in the begining of October and I have heard nothing from No ONe

NO It was\ not proven in court I never got my side heard only the landlords side and there was no visibiulity (Neither him or I wwere infront of the judge) And you are partially Right The lawsuit against me was for damages to the rental property i and my wife lived in for three Years The Damages I did not do and was not able to defend my self against.  

Back in April when The Inlaws removed the Trains from the house they were put in to the possesion of the inlaws During this time the Inlaws put the trains into Pawn which at that point made them stolen property this happened sometime between April and August when i was told about the pawn by my oldest son which was threatend with bodily harm if he told me but he finslaly did and I went through normal channels by contacting the Police. 

On September 21st I recevied Papers delivered by the sheriff that i was being sued for Damages to the rental property and back rent and damages to the refrigerator and stove Replacement of Carpet. 

I contacted legal aid and the lawyer called me and told me what to do and i followed his instructions to which if I lost in magisratye  Court  he wanted me to file an appeal to have the case sent up to circuit court. Again I have been waiting for a hearing and have heard nothing

The Trains were pulled out of pawn in November as the police were starting to close in on arresting his step daughter and his son in law also my inlaws who took the trains so that they would not be charges with theft. up until last night i was waiting for the police to contact me back about his conversation with the Magistrate about the Trains.  The officer came and saw me and told me that according to the magistrate i had no leg to stand on for a civil case as I had a judgement placed against me.  The other information was given about the Trains The Ex landlord who paid to have the trains gotten out of pawn told the cop that If I paid him the judgement amount I could have the Trains back

it seems as if you have far larger things to worry about than a few toys.The bottom line here is due to circimstances out of my control I am in a situtation that my life is tore up and my health is not good these trains were my Emotional support Animal per say they kept me on track.  being able to display my Trains at christmas to the public was a joy in my life and helped me handle my declining health issues. 

The Court issue and the Trains are Seperate Entities that got blended together because the Step dad protected his Step daughter to keep her out of jail

here it is in simple Terms 

side one landord tennant issue 

in Septmeber served papers on me and my wife from magi\strate court by Sheriff at my new current address read above and it is explained 

side Two In-laws stole the Trains when police closed in the Landlord which is Stepfather to my Inlaws wife he paid to have the trains taken out of pawn and because he paid to have them out of pawn he has possession of them

The post office/ The Court/ the Police all know my address there is no reason that I have not had a response from the court telling me I had a judgement against me 

And Yes I have had to accept that my trains are gone so yes I have lost my toys and my emotional support to keep me going to me these were more than toys and a hobby it was something to keeo my depression under control and to give me happiness in my life.
