What's the deal with the scale of the MTH 19thC 4-6-0?

Ok, so clearly the 19th Century 4-6-0 is a scale model of the Walter E. Disney 3' narrow gauge 4-6-0 at Walt Disney World, although for legal reasons apparently MTH has to pretend it isn't. Now it's obviously not a 1:48 model of the Walter E. Disney gauged out to standard. If it's scaled to the gauge, by my math that makes it roughly 1:29, so wouldn't that make it a Gn3 model? Can't we just admit this and put a 1:29 engineer in there? That tiny 1:48 engineer looks ridiculous.

for some reason I always thought it was 1:32. Not sure who told me that. I certainly looks to be around that scale.
