I had a triplex which started running eratically going slow and then fast. I had a new battery. I felt something was very wrong with the engine. When I put the engine on the test track, it did not act up. I reset the engine and replaced it on the layout. I have the latest version of dcs and legacy. The legacy is tied into only the command base and then into the track ground directly from the legacy base. The command base is not tied to the track. When I depowered the legacy base by pulling it's power plug, my engine started running perfectly. Before de-powering the legacy base, the remote wouldn't even recognize the engine. How does this happen ?

No. This is what really surprised me. I had forgotten it was even on since I was not running any legacy engines.
Let me rephrase the question.
Were there any Legacy or TMCC engines on powered tracks when the problem occurred, even if they were not started up?
Their were no Legacy or TMCC on any of the powered tracks. I had only ps2 engines on 4 seperate loops which were controlled by the tiu. Only one loop of these loops is connect to the legacy base. It was running the ps2 triplex. No other engine was on that loop.

What type of transformer are you using to power the tracks via the TIU?
What is the track voltage on the loop with the Triplex when it is exhibiting the odd behavior?
Is the Legacy command base connected to the TIU with a 50-1032 cable?
If so, will the behavior go away if the Legacy base is still plugged in, but the 50-1032 cable is disconnected?
If you are using the 50-1032 cable, are you also using the Y-cable that came with the Legacy system? Is the 50-1032 cable is connected to the "serial" or "TMCC" leg of the Y-cable?
