Copyright photos

You can’t delete photos posted by other members.

You will have to get those members to delete their own.

What a pain...

I don't want to start a war here, but it is annoying when you buy books at very high prices (and I have a lot of them)  you can't show the odd photo out of those books to illustrate a point to your friends which I regard the members here are my friends. I'm not making any money out of this I'm not in a business I don't buy and sell my trains or books, if anything I give them away, so it's not for any gain or profit that I would be doing this just for learning purposes.

I don't mind giving the name of the book and the person who takes the photo and the books get free advertising, but I know it's not the forum owners fault so I will be posting only MY OWN photos in the future which are not subject to any law or restriction.

So... if any member thinks they have posted a photo on my threads that could be breaching some law could they please remove them and let me know if I have done the same to their threads. Thank you.  Roo. (Neville in West Australia.)

I just posted a mild complaint here about TCA Western using my photos without attribution.  I consider that impolite, but it really is copyright infringement.

Then I saw the management thread - it was posted before my grousing.

Copying someone else's work is just not nice, and it violates copyright law.  We are a democracy, and if we don't like copyright and patent law, we can deluge our representatives and change it.

I personally think that posters here who nest posts using the quote button are violating copyright law.  Just because an artist posts here does not constitute permission to reproduce, even in the same thread.

Roo, there is another way. When you see that others have posted copyrighted material, report it, by clicking on the take action button in the lower right corner of the post. Hopefully, Alan won't be overwhelmed with reports, but it keeps him from having to search or taking more draconian actions.

We might just be able to police ourselves out of this mess.

I have an opinion on this matter, and it has nothing to do with the law. Anyone who posts something to the internet, should expect to have it copied! Frankly, if anyone wants to repost my stuff, I'm flattered, but I don't make a living off it.

I do see a difference between a harmless exposure use, like has happened here, and outright theft, where someone claims another's work for personal gain.

Generally I insert a LINK rather than copy and post an image for the reason of copyright.

Most of us are concerned with photos taken of trains by other photographers.  What about images of product for sale on eBay, Amazon, McMaster, etc?  I believe those are all covered by copyright as well.  I just read a short thread where half of the posts were images copy/pasted or screen-shot from vendor websites.

I bought a 1961  Famous  Soft serve Ice Cream Truck  ...  I was warned by the  company  ...Do not use their logos or songs..."BUT" they did say if I just use it for a Car show and not a business I could use the logo  and songs . lol .... made me wonder if I could charge them for advertising their products..

So the question begs, if you post one of your own pictures on the internet on a commercial forum does the photo become the property of the forum owner?

I'm sure most commercial entities jealously guard their intellectual property, including copyrighted images.  Not sure it does them well to have them buried on their own internet site as opposed to spread all over the internet. 

The law is the law, but you can't have it both ways.

May be??   I recently attempted to copy one of my photos from my Photobucket site, and was moved to a fee charging section of Photobucket.   Simple enough to copy the picture, from one of my photo-cards.   Somewhere in the terms of service, this is probably stated.  IMO   Mike CT.

They are covered; basically if you did not take the picture, the copyright resides with the photographer. 

And, you do not surrender copyright to any photo that you took and then post on any forum or host service, useless that is explicitly stated as one of the ToS that you agree to - Photobucket used to state within its ToS that you retained ownership of your photos.  It that has changed, it's been in the last 2-3 years after I closed my account there.

There is something however called fair use and that generally pertains to educational and teaching use of copyrighted materials; also applies to applications such as information services such as news and also in use for parody. 

Totally rigid application of copyright restrictions here will of course eliminate the posting of almost all photos that people here did not take themselves.  All those photos of all the importers and manufacturers wares will not be available here except from the actual originating sources.

A couple of issues here....first of all, take a look at Simon's post above.  This takes care of the problem so I doubt that we are going to have a situation of almost all photos being eliminated as stated above.  Manufacturers and vendors have no problem generally with you going to their site and posting pictures of their product here...this helps them sell.  They own their images but you are doing them a favor and they know it.  Finally, as I have said before....when you go online and would like to use a picture from a book site or photographer's site, they generally have a way for you to contact them and ask permission to use their picture.  They may ask you to also put a link in your post and credit given...but I have found that most give their permission once they know it is going to be posted here.  Guys...the sky is not falling but just be aware that you should abide by copyright.  Doesn't mean you can't post pictures....  Enough said...we don't need more of these threads so topic closed.  Go back and enjoy the forum....
