I don't know all the why's and wherefore's, but I recall Mike Wolf indicating he LICENSED the Lionel name to play off the Nostalgia factor of tinplate.  Any tinplate that MTH produces that's not under the Lionel Corporation Tinplate umbrella is part of MTH's Tinplate Traditions line.

I also recall Mike Wolf mentioning he probably would NOT have expanded the Standard Gauge Tinplate offerings to the degree he did in recent years, if he had not acquired the license to use Lionel's name either on the rolling stick or at least on the Lionel Corporation Tinplate product boxes that evoke images of nostalgic charm.  So while both companies have their competitive issues to deal with, there's still an acknowledgement on MTH's part that the Lionel brand carries a ton of weight when it comes to selling a product that bears it's name.

It is my understanding that the contract is through 2020.  So unless they renegotiate the window may be closing.

When MTH won it's second suit against Lionel in the earlier part of the last decade , one of the things that Lionel agreed to was that the tinplate would all be made by MTH and the Lionel name applied and Lionel was paid a royalty for this. The bulk of any profits would accrue to MTH. That's why you see Protosound in the tinplate Lionel engines and not TMCC or Legacy.
