Good Morning All - I am looking at a Legacy locomotive on Ebay from 2008 but I remember something about the early legacy locos having issues with lashups or newer versions of the operating software. Could the forum confirm any issues I may run into or if its OK to proceed? Thank you.

Here's info about lash ups. which-legacy-locomotives-can-t-be-lashed-up-with-other-models?
I've heard nothing about the version of the Legacy firmware affecting older Legacy locomotives. I have a bunch of older Legacy locomotives, and my Legacy command system at 6.00/6.01 has no problem operating them correctly, including MU configurations.
Lionel did use a 9 bit version of an ERR Cruise M in at least one engine. No idea what it was though. If you want to make sure an early engine will work, look it up at Lionel's parts site, lionelsupport.com, and see if the motor has a tach sensor. If it does it will run in a lashup with newer Legacy engines.

The one exception may be the Legacy Shay, I haven't tried it in an MU with another legacy locomotive, but it's speed curve certainly seems like it would be a problem. FWIW, my Shay does have the tach sensor and the RCMC board.
