I have been using a Lionel #990 that had never been used before. It was never sent in to be upgraded from Legacy V1.0. I emailed Lionel and they say you can't send the base in anymore. Is there any way to upgrade it?

Did you make it clear to them it was the 1.0 repair and not a general repair? You might want to phone and talk to them.
As far as I know, only Lionel can do the fix. You may be out of luck, but it's not like you didn't have many years to get it taken care of.
No way I know of to upgrade it as Lionel has the updated code that makes the base compatible with customer software upgrades.
Please remind me why the upgrades matter. Is it just for Legacy features? Have two 990's purchased in 2015 and 2016 that never have been "upgraded". The newest locomotives owned are TMCC from the 2006 catalog. Also have two Legacy PowerMasters purchased in the same timeframe if relevant.
Asking for the benefit of future owners.

Many features and corrections were added to the Legacy system over the years via upgrades, I'd go look at the update logs to see all the upgrades.
Give Lionel a call. They should still be able to upgrade it.
