8103 N&W Legacy not responding

I have a Lionel 8103 N&W that will not respond to legacy when i first start up. Until know the 8103 has worked without any problems what so ever. I have learn if I can warm the unit before operating .....it will then run correctly. (my train garage is not heated) Is this a sign that the receiver is going bad?
