Seems there are many folks complaining about everything from technical issues, DOAs, and cosmetic and physical damage.
Has Lionel offered an explaination, apology, or remedy?

I'm sure the remedy is Lionel fixing them if a replacement from the retailer isn't available.
Remember, you're hearing about the problems, not the folks that have them and are not having issues. We don't really know what percentage are actually experiencing issues.

Are you saying theres some kind of warranty policy on these. this must be something new.
Gee, I sent a 3-year old Legacy back last year and they fixed it for free, so I suspect these new ones are still under warranty.

So your saying lionel is standing behind these even after the original warranty expires?
Hmmm, they must think this is a fairly important component to operate legacy locomotives with.
I don't know about other folks, but the Legacy system is pretty important to me for my Legacy stuff, and it runs the TMCC stuff really well too.
I hear tell that people run the Legacy stuff in conventional and with the old CAB1, so it's not important to everyone.
So did you get a refund? What compensation were you looking for? Pain and suffering?
Its such a shame that you pop up on every thread with the same old rants like no one notices.

never heard of a legacy set.
Regardless...it is buyer beware just like anything, don't sit on a sealed box, get it out and test it.
These trains are expensive, at least a few hundred dollars up thru and beyond $2k sometimes.
Most OGR sponsors if not all will make good on it someway or another.
I have no faith in Lionel or MTH when it comes to sending stuff back to get fixed.
I sent a stuttering horrible running Premier DD-1 that was only a few weeks old to MTH and was willing to pay for repairs.
They sent it back saying they could not find anything wrong with it.
I trust an OGR sponsor more than I trust lionel or MTH.

Gee... Isn't Lionel an OGR sponsor?

In all seriousness chipset, I understand your concern. The few issues I have had with Lionel products were addressed promptly in response to emails and things were made right accordingly.
Any questions I've had regarding my own "out of warranty" parts/ repair were always answered quickly with part info so I could correct the problem.
In one instance I had an "out of warranty" loco that I bought new old stock. A few legacy accessory lighting control features did not function, ( no ability to turn them off ) I contacted Lionel about the issue, and said I was content leaving it alone if necessary.
The immediate response was a return shipping label, loco was returned within 2 weeks and all features operate as described.
Its unfortunate that "issues" are a part of a hobby that is to "narrow marketed" for more reliablity. If Lionel was the only manufacturer with out of box issues I'd be more hesitant. However, problems are possible across all brands, even the brass manufacturers that only produce a couple hundred locos.
I enjoy this hobby. The attention Lionel has given me when it comes to "making things right" makes me confident that if issues arise in the future I will be able to get them taken care of. I'm actually more "leary" of some other brands that do not have the "parts/service" setup/ capabilities that Lionel has.
I might be the opposite. Yes, I have concerns when I read about problems, especially electronic board problems. Believe me, I've had them, some not even brought up yet from what I've read. But have had good luck with MTH and especialy the services of Atlas, even sending me parts long out of production but had laying around.
What I find, or should say feel when someone has a concern, or is critical about a product and operating problem(s), how some brush it aside. I feel something is wrong in our hobby when if 100.00 or 2000.00 dollars are spend on an item and its not operating correctly, or damaged when its unpacked.
I bought a never run, Mint in the box, K-Line engine 5 years ago before I came here on this Forum. When it was put on the track, it smoldered the board. It had a warranty, even though never opened nor run mint in the box. The warranty expired. I was left with a 300.00 hunk of plastic and metal that I cleaned and use as a display to remind me forever to check all my purchases out.
I haven't had to send anything back to MTH, Lionel or Atlas for repair, but I have ordered parts from all 3 and asked them some technical questions about products. All of my experiences have been positive, a couple of them went out of their way to help. I have no complaints with any of them, only good things to say. I'm sure I will have a problem sooner or later (hopefully later) and I expect it will be taken care when the time arises. I think all these companies try as best they can to keep us satisfied.
That's been my experience, too. Never had a problem with getting things taken care of by Lionel. What I'm "leary" of is tales of certain folks about some horrible experience they had with Lionel. Makes me think there's more to the story than they're telling.
Well for what its worth, my brand new MTH LIRR MU, right out of the box and on the track, stops after about one car length, then makes a high revving motor or gear noise, and the PS3.0 sound effects stop as well.
Looks like its going back to MTH for warranty repairs, as my other MTH engines are all running fine on the layout etc.
