Good morning all,

 

 My good friend and fellow forum member Mike R just sent this video he found on you tube to me. I don't know if any of you seen it already, if you haven't this has to be one of the nicest video's I've seen. Please watch  the entire video and if any of you guys know about this layout we would love to hear about it. Make sure you turn up the volume

Is that a great layout and video or what?! I knew you'd like it. Thanks for posting it. What a beautiful layout that is and the video is terrific as well. I really enjoy the cab view and the background music is terrific as well.

 

I hope you guy's enjoy it also!

 

Does anyone know who's layout that is? And is he a member of the Forum?

Great video!  I love New York!  And this makes me want to go back and ride the subways.  In April 1995 on top of the Empire State Building I asked my then girlfriend the BIG question holding a sparkling ring and she said, "Yes!"  Then we went and bought the perfect basement for a layout that happend to come with a house on top of it.

I would bet tons of money that most folks here wouldn't even think it's "wrong" to use copyright material in this way.  But it is indeed.  

 

OTOH, it's doubtful Sinatra's or Elvis Presley's lawyers are gonna chase these folks down... But stranger things have happened when videos go viral on the Internet!    Seriously, you can't get more high profile than Sinatra and Presley.  So please be careful.

 

Music licensing is beyond the scope of this forum... But suffice it to say that the music industry has NOT made it easy to license copyright content.  One needs to purchase multiple types of licenses (master-usage, sync, etc...) in order to legally use copyright music in this fashion.  And for that reason, choosing royalty-free music is a much safer alternative when creating your videos -- at least until the music industry landscape changes.  You'll be able to sleep easier knowing you won't get a phone call from Sinatra's lawyers ...  although Frank probably wouldn't mind it in this case 'cause he was such a toy train enthusiast!!!

Very interesting responses about this video being so entertaining and inspirational.  The layout is very nice indeed.

 

But being the creative professional that I am, I'm curious to hear from those who got a great response from other members of the family.  Or for that matter, even those of YOU who were wow'd by the entire production.  How much of your reaction is based on the familiarization with the songs used in the audio track that admittedly help get those juices flowing???

 

It's for this reason that copyright-protected music needs to be licensed when "used" like this..  Granted... We're just playing around here, and we enjoy seeing nice trains in terrific layout settings.  But if you ever even think about producing a professional video for sale... Don't even think about using copyright-protected music without obtaining the appropriate licenses.  Buying your own copy of the music is not a license to USE the music in productions designed for profit -- or for that matter, any form of public viewing.

 

Just sayin'...  

 

Now back to the regularly scheduled programming at hand...  Enjoy!!!

Regarding the copyright issue and Youtube.   Frank's music falls outside of Warner Music Group.  His music is under EMI.   EMI has allowed YouTube to use music as long as the fees are paid (ASCAP and BMI), and the artist (if he owns the rights) doesn't object.  Even then, some other technicalities fall into place.

 

So yes, generally, copyright is an issue, in this specific case they are okay using this.

 

This (music copyright) is an area of which I am intimately familiar on a daily basis. My publishing company owns my music (and I own the pub. co.).
