The legacy handheld works great in the cab one mode and r100 mode and set at 100 speed steps. If I put the hand held in the tmcc mode so I can get a nice slow acceleration rate with the setting at 6 I get a slow speed that is twice as fast as the other two modes. The old eob would do very well in the tmcc mode with a momentum setting of 6 in tmcc mode. What gives?

The steps are larger for the Cruise Commander in TMCC mode, I believe it's really as simple as that. I run all my ERR CC stuff in R100 mode for that reason.
The EOB had a ramp-up speed built in, the CC just responds to the current command from the remote.
