NS at one time had trackage rights over the FEC. They ran the Intermodals to the Port of Miami, mostly at 1-2 AM. As far as i know, they don't have trackage rights anymore. The FEC now runs the hotshot intermodals. It's too bad, cause then I'd have a chance to see the Heritage engines. As far as the FEC selling out to NS, i don't think that will happen anytime in the near, middle or far future.

I seriously doubt that NS ever had "truckage rights" over the FEC. Run-through motive power, may well have been involved.

I just did some checking of the current state of affairs vis-a-vis the trackage rights for NS over the FEC. There were trackage rights back in the '80's, but that agreement was terminated. The trackage rights were replaced with a Haulage Agreement. Apparently, FEC terminated its' Haulage Agreement with NS in 2011/2012, along with the separate Titusville Intermodal Agreement which allowed NS to run to its'(NS) Titusville Intermodal Facility.

 

The dispute was/is apparently about the rates that Both NS and FEC had agreed to in the original Agreement. From what I read in the legal stuff I found, NS wanted to pay FEC a lot less money than they had been paying. There were several suits and countersuits by both parties, with the US District Judge deciding that the dispute should go to binding arbitration(which the FEC wants). All pending legal actions are now on hold until the outcome of the arbitration, which will occur later this year.
